Acceptance of Terms
By accessing or using the website, member portal, courses, and services of the Nigerian Institute for Chartered Waste Managers (NICWM), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you must not use our services. These terms apply to all visitors, users, applicants, and members of NICWM. We reserve the right to modify these terms at any time, and your continued use of the services after any changes constitutes your acceptance of the revised terms.
Membership Eligibility and Application
Membership in NICWM is open to individuals who meet the eligibility criteria for their chosen membership category. By submitting a membership application, you represent and warrant that all information provided is accurate, complete, and truthful. NICWM reserves the right to review, approve, or reject any application at its sole discretion. Membership fees, if applicable, must be paid in accordance with the terms specified during the application process. Membership status and benefits are subject to the bylaws and regulations of NICWM.
User Accounts and Security
To access certain features of our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. NICWM will not be liable for any loss or damage arising from your failure to protect your account information.
Course Enrollment and Certification
Course enrollment is subject to availability and eligibility requirements. Upon successful completion of a course and fulfillment of all requirements, you may receive a certificate of completion or certification as applicable. All course materials are the intellectual property of NICWM or its licensors and are provided for your personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from course materials without prior written consent.
Intellectual Property
All content on the NICWM website and portal, including but not limited to text, graphics, logos, images, videos, course materials, and software, is the property of NICWM or its content suppliers and is protected by Nigerian and international copyright, trademark, and other intellectual property laws. You may not use any of our trademarks or service marks without our prior written permission. Unauthorized use of any content may violate these laws and result in legal action.
Prohibited Conduct
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. Prohibited activities include but are not limited to: attempting to gain unauthorized access to any part of our systems, interfering with other users access or use of our services, uploading or transmitting viruses or malicious code, harvesting personal information of other users, impersonating any person or entity, and engaging in any activity that violates applicable laws or regulations.
Payment and Refunds
All fees and charges for membership applications, course enrollments, and other services are as displayed on our website at the time of purchase. Payments must be made through the approved payment methods provided. Refund policies, if any, are specified at the point of purchase or in separate agreements. NICWM reserves the right to change pricing for its services at any time with reasonable notice.
Limitation of Liability
To the fullest extent permitted by law, NICWM and its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services. This includes damages for loss of profits, goodwill, data, or other intangible losses. Our total liability to you for any claim arising from these terms or your use of our services shall not exceed the amount you paid to NICWM, if any, in the twelve months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless NICWM and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys fees) arising out of or in any way connected with your access to or use of our services, your violation of these terms, or your infringement of any intellectual property or other rights of any person or entity.
Termination
We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice, for any reason or no reason. Upon termination, your right to use the services will immediately cease. All provisions of these terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.
Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or relating to these terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through arbitration or the courts of Lagos State, Nigeria, as determined by NICWM in its sole discretion.
